If you do not agree with any part of these terms, you must immediately cease all use of our Service.

Our Service is designed for learners under the age of 18 ("Minors"). However, an account must be created and managed by a Parent or Legal Guardian.

• Parental Consent: By creating an account, you represent that you are at least 18 years old and are the parent or legal guardian of the minor using the Service.
• Responsibility: You assume full responsibility for all activities performed by the minor through the Service.
• Verification: We reserve the right to verify parental consent through industry-standard methods.

To access certain features, you must register for an account. You agree to:

• Provide accurate, current, and complete information.
• Maintain the security of your password and identification.
• Promptly update account information to keep it accurate.
• Notify us immediately of any unauthorized use of your account.

We are not liable for any loss or damage arising from your failure to comply with these security obligations.

Intellect Council provides an AI-first learning ecosystem. You acknowledge and agree that:

• Adaptive Nature: The learning paths are generated by AI algorithms and are probabilistic. While we strive for accuracy, AI may occasionally produce incorrect or unexpected results.
• No Professional Advice: Educational content is for informational purposes only and does not constitute professional academic, career, or legal advice.
• Service Availability: We do not guarantee that the Service will always be available, uninterrupted, or error-free.

Users are strictly prohibited from:

• Using the Service for any illegal or unauthorized purpose.
• Attempting to hack, decompile, or reverse engineer any part of the platform.
• Circumventing any safety filters, content moderation systems, or access controls.
• Uploading malicious code, viruses, or any software that may harm our infrastructure.
• Using AI tools to generate harmful, offensive, or inappropriate content.

All content on the Service, including but not limited to text, graphics, logos, software, and AI-generated modules, is the property of Tosh Innovations Private Limited or its licensors and is protected by international copyright and trademark laws.

We grant you a limited, non-exclusive, non-transferable license to access the Service for personal, non-commercial educational use only.

Intellect Council offers Free, Standard, and Premium tiers.

• Automatic Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
• Pricing: We reserve the right to change our pricing at any time. Any changes will be notified in advance.
• Cancellations: You can manage and cancel your subscription through your App Store settings or account dashboard.

You agree to defend, indemnify, and hold harmless Tosh Innovations Private Limited, its directors, employees, executives, agents, and partners from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:

• Your use of and access to the Service.
• Your violation of any term of these Terms & Conditions.
• Any claim that your use of the Service caused damage to a third party.

The service is provided on an "as is" and "as available" basis without any warranties of any kind, whether express or implied.

To the fullest extent permitted by law, we disclaim all warranties, including but not limited to the warranty of merchantability, non-infringement of proprietary rights, and fitness for a particular purpose.

In no event shall Tosh Innovations Private Limited, its directors, employees, executives, or partners be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL BE LIMITED TO THE TOTAL AMOUNT PAID BY YOU TO US FOR THE SERVICE DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
